Your data

Privacy Policy

Your network is yours. Here is what we collect, why, and the controls you get.

Effective date: October 23, 2026. This policy reflects 2026 U.S. privacy requirements, including expanded state privacy rights and opt-out preference signal (Global Privacy Control) handling.

1. Introduction

Welcome to SparkUp Biz Inc (“we,” “us,” “our”). We are committed to protecting your privacy and ensuring the security of your personal information.

This Privacy Policy describes how we collect, use, disclose, and protect your information when you use our business networking social media platform (the “Platform”). By using our Platform, you agree to the terms of this Privacy Policy.

If you do not agree with these terms, please do not use our Platform.

2. Information We Collect

Personal information

We may collect personal information that you provide to us directly, including but not limited to:

  • Contact information: name, email address, phone number
  • Profile information: professional details such as job title, company name, industry, profile picture, and biography
  • Interaction data: information you provide when you communicate with other users or us, including messages, posts, comments, and other content
  • Payment information: billing details are processed by our payment processor — we never see or store your full card number

Non-personal information

We may collect non-personal information automatically when you interact with our Platform, including but not limited to:

  • Usage data: browser type, operating system, device type, IP address, pages visited, time spent on pages, and links clicked
  • Cookies and tracking technologies: information collected through cookies, web beacons, and similar technologies (see Section 5)

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide and maintain our Platform: ensuring the smooth operation and functionality of the Platform
  • To improve and personalize your experience: customizing content and recommendations based on your preferences and interactions
  • To communicate with you: sending administrative information, updates, security alerts, and support messages
  • To facilitate networking: enabling you to connect with other users, join groups, and participate in discussions
  • To analyze usage: monitoring and analyzing usage patterns to enhance the Platform’s performance and user experience
  • To comply with legal obligations: fulfilling legal requirements, such as responding to subpoenas and court orders

4. Information Sharing and Disclosure

We do not sell your contact information. We do not sell your personal information, and we do not show your private messages or referrals to anyone outside the conversation.

We may share your information with:

  • Service providers: third-party vendors who provide services on our behalf, such as hosting, data analysis, customer service, and marketing
  • Legal and regulatory authorities: when required by law or to protect our rights, property, or safety, and that of our users or the public
  • Business transfers: in the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the new entity

5. Cookies and Tracking Technologies

We use cookies, web beacons, and similar technologies to operate the Platform, remember your preferences, understand usage, and keep spam and bots out. You can control cookies through your browser settings: you may block or delete cookies, but some parts of the Platform may not work correctly without them.

Where required by applicable law, we obtain your consent before using non-essential cookies and honor opt-out preference signals such as Global Privacy Control (GPC) as a valid request to opt out of the sale or sharing of personal information and targeted advertising.

Marketing emails include unsubscribe instructions. Transactional and security messages (for example, password resets and safety alerts) may still be sent because they are necessary to operate your account.

6. Data Security

We implement reasonable security measures to protect your information from unauthorized access, disclosure, alteration, and destruction, including access controls, encryption in transit, and monitoring for abuse.

However, please be aware that no data transmission over the internet or electronic storage method is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.

7. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described in this policy — to operate your account, provide the Platform, comply with legal obligations, resolve disputes, and enforce our agreements.

When you close your account, we delete or de-identify your personal information within a reasonable period, except where we must retain it for legal, safety, or legitimate business record-keeping purposes.

8. Your Rights and Choices

You have the right to:

  • Access your information: request a copy of the personal information we hold about you
  • Update your information: correct any inaccuracies in your personal information, including from your profile and account settings
  • Delete your information: request the deletion of your personal information, subject to certain exceptions (for example, where we must retain records by law) — or delete your account yourself at any time from Billing → Danger zone. Self-service deletion is immediate and permanent: your profile, posts, messages, connections, files, subscriptions, and payment history are wiped after active subscriptions are cancelled
  • Opt out of marketing: unsubscribe from marketing communications by following the instructions in the emails you receive

To exercise any of these rights, please contact us at contact@sparkupbiz.com. We will verify your identity before fulfilling your request and will respond within the timeframes required by applicable law.

9. U.S. State Privacy Rights (2026)

Depending on where you live, you may have additional rights under applicable U.S. state privacy laws (including California, Colorado, Connecticut, Delaware, Montana, Oregon, Texas, Utah, Virginia, and similar laws), including the rights to:

  • Know and access the categories and specific pieces of personal information we hold
  • Correct inaccurate personal information
  • Delete personal information, subject to legal exceptions
  • Opt out of the sale or sharing of personal information and targeted advertising, including via an opt-out preference signal such as GPC
  • Limit the use of sensitive personal information, where applicable
  • Appeal a decision on your privacy request
  • Not be discriminated against for exercising your privacy rights

You may designate an authorized agent to submit a request on your behalf where permitted by law; we will require proof of authorization and may still need to verify your identity. To submit a request or an appeal, email contact@sparkupbiz.com.

We do not use or disclose sensitive personal information for purposes that would require an opt-in or limit-use right beyond operating the Platform as described in this policy.

10. Third-Party Links

Our Platform may contain links to third-party websites. We are not responsible for the privacy practices or content of these external sites. We encourage you to review the privacy policies of any third-party sites you visit.

11. Children’s Privacy

Our Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected such information, we will take steps to delete it.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our Platform with the effective date. Your continued use of the Platform after any changes indicates your acceptance of the updated Privacy Policy.

13. Limitation of Liability

To the fullest extent permitted by applicable law, SparkUp Biz Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii) any unauthorized access, use, or alteration of your transmissions or content; or (iv) any other matter relating to the Platform.
